PoolMarketing.com ROAS Dashboard Terms of Use

Effective date: July 28, 2026

These Terms of Use govern access to and use of the PoolMarketing.com ROAS Dashboard, related websites, reporting interfaces, integrations, software, and services collectively referred to as the “Dashboard.”

The Dashboard is operated by PoolMarketing.com, referred to in these Terms as “PoolMarketing.com,” “we,” “us,” or “our.”

By accessing or using the Dashboard, you agree to these Terms. If you are accessing the Dashboard on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, you may not access or use the Dashboard.

1. Purpose of the Dashboard

The Dashboard is a business intelligence and advertising reporting application designed to help authorized users review advertising costs, campaign performance, lead activity, sales information, attributed revenue, and return on advertising spend.

The Dashboard may obtain information from authorized third-party platforms, including advertising networks, customer relationship management systems, call-tracking platforms, scheduling systems, analytics platforms, and job-management software.

The Dashboard is not an accounting platform, financial advisory service, tax service, or audited financial reporting system.

2. Eligibility and Authorized Use

You may only use the Dashboard if:

  • You are at least 18 years old.
  • You have authority to access the connected advertising and business accounts.
  • PoolMarketing.com has approved your access.
  • Your use complies with these Terms and applicable law.
  • You are not prohibited from using the Dashboard by any applicable platform agreement or governmental restriction.

Access may be limited to PoolMarketing.com personnel, clients, contractors, and other specifically authorized users.

There is no general right to register for or access the Dashboard.

3. User Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring through your account.

You agree to:

  • Provide accurate account information.
  • Use only your assigned credentials.
  • Keep your password and authentication information secure.
  • Notify PoolMarketing.com promptly of suspected unauthorized access.
  • Log out or otherwise secure your account when using a shared device.
  • Avoid sharing screenshots, exports, or reports with unauthorized individuals.

PoolMarketing.com may suspend or terminate access when it reasonably believes an account has been compromised, misused, or accessed without authorization.

4. Connected Accounts and Authorization

You may only connect or authorize advertising, CRM, call-tracking, analytics, scheduling, or job-management accounts that you own or are legally authorized to administer.

By connecting an account, you authorize PoolMarketing.com and the Dashboard to retrieve, process, display, and analyze information from that account for the purpose of providing reporting, attribution, optimization, account management, and related marketing services.

You represent that:

  • You have obtained any necessary authorization from the account owner.
  • Your instructions do not violate a third-party agreement.
  • You have provided any legally required notices to employees, customers, leads, or other individuals whose information may be processed.
  • The data provided through the connected account was collected lawfully.

You may revoke an integration through the applicable third-party platform or by contacting PoolMarketing.com. Revocation may prevent some or all Dashboard features from operating.

5. Google Ads API Use

The Dashboard may use the Google Ads API to retrieve reporting information from authorized Google Ads accounts.

Unless expressly stated otherwise in writing, the Dashboard’s Google Ads integration is used for reporting and analysis. It is not used to make automated bid changes, create campaigns, modify keywords, change budgets, publish advertisements, or otherwise alter a Google Ads account.

Your use of Google Ads and other Google services remains subject to the agreements and policies established between you and Google.

Google is not responsible for the Dashboard, and PoolMarketing.com is not affiliated with or endorsed by Google solely because the Dashboard uses the Google Ads API.

6. Permitted Use

You may use the Dashboard only for legitimate internal business purposes associated with your organization or the services PoolMarketing.com provides to your organization.

You may not:

  • Access information belonging to another client or unauthorized account.
  • Attempt to bypass authentication or security controls.
  • Probe, scan, or test the vulnerability of the Dashboard.
  • Interfere with the Dashboard’s operation or connected services.
  • Reverse engineer, copy, resell, sublicense, or redistribute the Dashboard.
  • Use automated tools to scrape or extract data without written permission.
  • Upload malicious code or use the Dashboard to distribute malware.
  • Misrepresent Dashboard information as audited or independently verified.
  • Use the Dashboard for unlawful, fraudulent, deceptive, or abusive activity.
  • Share confidential campaign, lead, customer, or revenue information without authorization.
  • Use the Dashboard in a manner that violates another platform’s terms or policies.

7. Advertising and Attribution Data

Dashboard calculations depend on information received from third-party systems and information entered or maintained by users.

Results may be incomplete, delayed, duplicated, estimated, incorrectly categorized, or affected by:

  • Tracking limitations
  • Cookie restrictions
  • Consent settings
  • Offline transactions
  • Incomplete CRM records
  • Unanswered or untracked phone calls
  • Duplicate leads
  • Incorrect revenue values
  • Changes to third-party APIs
  • Advertising attribution models
  • Platform outages
  • User configuration errors

PoolMarketing.com does not warrant that every lead, sale, conversion, or revenue event will be tracked or attributed accurately.

8. ROAS and Financial Information

ROAS and related metrics are estimates intended to assist with marketing decisions.

Unless otherwise specified, ROAS is calculated by dividing attributed revenue by advertising spend. Different platforms may use different attribution windows, conversion definitions, revenue values, or reporting methodologies.

Dashboard information should not be relied upon as:

  • Audited financial information
  • Tax advice
  • Legal advice
  • Investment advice
  • A guarantee of future performance
  • A substitute for reviewing source-platform and accounting records

You remain responsible for verifying financial information before making material business decisions.

9. Third-Party Services

The Dashboard depends on services operated by third parties.

PoolMarketing.com does not control and is not responsible for the availability, accuracy, security, policies, or practices of third-party services.

A third party may change or discontinue its API, reporting methodology, authentication process, data fields, pricing, or functionality at any time. Such changes may interrupt or permanently affect Dashboard features.

Your use of third-party services remains governed by the terms and privacy policies of those providers.

10. Confidentiality

Information displayed through the Dashboard may include confidential business information belonging to PoolMarketing.com, its clients, or third parties.

You agree to protect confidential information using reasonable care and to use it only for its authorized business purpose.

You may not disclose confidential information to another person unless that person is authorized to receive it or disclosure is required by law.

11. Intellectual Property

The Dashboard, including its design, software, source code, interfaces, reports, calculations, branding, written content, and documentation, is owned by PoolMarketing.com or its licensors and is protected by intellectual property laws.

Subject to these Terms, PoolMarketing.com grants authorized users a limited, revocable, nonexclusive, nontransferable license to access and use the Dashboard for approved internal business purposes.

No ownership rights are transferred to you.

Your organization retains its rights in the business information it provides or authorizes the Dashboard to access.

12. Availability and Modifications

PoolMarketing.com may modify, update, suspend, restrict, or discontinue any portion of the Dashboard at any time.

We do not guarantee uninterrupted access. Maintenance, software updates, third-party outages, security incidents, internet failures, and other circumstances may cause temporary or permanent interruptions.

We may establish or modify usage limits when reasonably necessary to protect the Dashboard, comply with third-party requirements, or maintain system performance.

13. Suspension and Termination

PoolMarketing.com may suspend or terminate access if:

  • You violate these Terms.
  • Your client relationship with PoolMarketing.com ends.
  • You fail to pay applicable fees.
  • A connected account is no longer authorized.
  • Your activity creates a security or legal risk.
  • A third-party provider requires suspension.
  • Continued access could harm PoolMarketing.com, another user, or a third party.

Upon termination, your right to access the Dashboard ends immediately.

Termination does not eliminate obligations that reasonably should survive termination, including confidentiality, intellectual property, disclaimers, limitations of liability, indemnification, and dispute provisions.

14. Disclaimer of Warranties

To the maximum extent permitted by law, the Dashboard is provided “as is” and “as available.”

PoolMarketing.com disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, availability, accuracy, and security.

We do not warrant that:

  • The Dashboard will be uninterrupted or error-free.
  • All data will be complete or accurate.
  • Every conversion or sale will be properly attributed.
  • Use of the Dashboard will increase revenue or profitability.
  • Third-party integrations will remain available.
  • Errors or security vulnerabilities will always be corrected.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

15. Limitation of Liability

To the maximum extent permitted by law, PoolMarketing.com and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the Dashboard.

This includes loss of profits, revenue, data, business opportunities, advertising spend, goodwill, or anticipated savings.

To the maximum extent permitted by law, PoolMarketing.com’s total aggregate liability arising from or related to the Dashboard will not exceed the amount your organization paid specifically for access to the Dashboard during the three months preceding the event giving rise to the claim.

If access to the Dashboard is included as part of a broader marketing-services agreement without a separately stated fee, PoolMarketing.com’s total aggregate liability relating specifically to the Dashboard will not exceed $100.

Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.

16. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless PoolMarketing.com and its owners, employees, contractors, affiliates, and service providers from claims, losses, liabilities, damages, judgments, and expenses, including reasonable attorneys’ fees, arising from:

  • Your misuse of the Dashboard.
  • Your violation of these Terms.
  • Your unauthorized connection of an account.
  • Your violation of another person’s rights.
  • Data you provide or authorize the Dashboard to process.
  • Your failure to provide required privacy notices or obtain required consent.
  • Your violation of applicable law or a third-party agreement.

17. Privacy

Our collection, use, storage, and disclosure of personal information associated with the Dashboard are described in the PoolMarketing.com ROAS Dashboard Privacy Policy.

The Privacy Policy is incorporated into these Terms by reference.

18. Changes to These Terms

PoolMarketing.com may update these Terms periodically.

When changes are made, the revised Terms will be posted with an updated effective date. Material changes may also be communicated through the Dashboard, by email, or through another reasonable method.

Continued use after revised Terms become effective constitutes acceptance of the revised Terms.

19. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Any dispute arising from or related to these Terms or the Dashboard shall be brought in a state or federal court located in the county in California where PoolMarketing.com maintains its principal place of business, unless the parties have entered into a separate written agreement establishing another dispute-resolution process.

20. General Provisions

These Terms, the Privacy Policy, and any applicable written service agreement constitute the agreement governing your use of the Dashboard.

If a provision is found unenforceable, the remaining provisions will remain effective.

PoolMarketing.com’s failure to enforce a provision is not a waiver of its right to do so later.

You may not assign your rights under these Terms without written permission from PoolMarketing.com. PoolMarketing.com may assign its rights and obligations in connection with a merger, acquisition, asset sale, corporate restructuring, or similar transaction.
